EFT Disclosure and Terms
The following information explains the terms and conditions for
using our JDECU Web Site service (including secure site CU at Home)
and describes the various types of electronic funds transfers which
are available to you with the CU at Home service and your rights
and responsibilities concerning these transactions, including your
rights under the Electronic Fund Transfers Act. The Jack Daniel
Employees’ Credit Union Web Site is offered to you conditioned
upon your acceptance without modification of the terms, conditions,
and notices contained herein. Your use of the Jack Daniel Employees’
Credit Union Web Site constitutes your agreement to all such terms,
conditions and notices. Each of your accounts at Jack Daniel Employees’
Credit Union is also governed by the applicable account disclosure/agreement
and Truth-In-Savings disclosure you received when you opened your
accounts. For the purpose of this disclosure Jack Daniel Employees’
Credit Union will be referred to as JDECU.
Account Access:
JDECU reserves the right to change the terms, conditions, and notices
under which the JDECU Web Site services are offered. You are responsible
for regularly reviewing these terms and conditions and additional
terms. Your continued use of the JDECU Web Site services constitutes
your agreement to all such terms, conditions and notices.
To access your account through our CU at Home service, you must
have your account number and a password. This information is requested
when you enter our CU at Home pages from our web site.
The password that is used to gain access to your information should
be kept confidential, just as you would keep other PIN numbers and
security codes confidential. For your protection, we recommend that
you change your CU at Home access password regularly. It is recommended
that you memorize this password and do not write it down. You are
responsible for keeping your password, account number(s) and other
account data confidential. If you believe that your password may
have been lost or stolen, or that someone has transferred or may
transfer money between your accounts without your permission, notify
Jack Daniel Employees’ Credit Union at once at (931) 759-6157.

To get an initial password for the CU at Home service, complete
an enrollment form and mail it to Jack Daniel Employees’ Credit
Union, PO Box 199, Lynchburg, TN 37352 or drop it by our office.
You will be required to change your initial password when you first
login.
Personal and non-commercial use limitation:
Unless otherwise specified, the JDECU Web Site is for your personal
and non-commercial use. You may not modify copy, distribute, transmit,
display, perform, reproduce, publish, license, create derivative
works from, transfer, or sell any information, software, products
or services obtained from the JDECU Web Site.
Fees
There are no monthly fees and/or transaction fees for accessing
your account(s) through our
CU at Home internet banking service. We do not intend to charge
in the future for the service, but reserve the right to do so after
providing 30 days advance notice to all users at the
CU at Home login page.
Your Internet service provider (ISP) may charge a fee to access
the Internet via its server. We have no control over ISP related
fees.
Other fees that may apply include overdraft fees for non-sufficient-funds
or excessive withdrawal fees for club accounts which are outlined
in your Truth-In-Savings disclosure. Although account balances appear
in our CU at Home web pages, these balances are current through
the last upload of information and are not a live feed from your
account. Please be sure to balance your account with any current
information you may have such as share drafts that have not cleared
your account as of the last upload from our system. Careful maintenance
of transactions will help you to avoid overdraft fees.
Available Services and Limitations
The following information describes the various types of electronic
funds transfers which are available to you with the CU at Home service
and your rights and responsibilities concerning these transactions,
including your rights under the Electronic Fund Transfers Act. Please
read this document carefully. You may print or save this document
for future reference or you may request a copy by telephoning us
at (931)759-6157.
Electronic Fund Transfers are deposits to, withdrawals from, transfers
between your accounts, or cross-member transfers which are not originated
by check, draft or similar paper instrument. If your account(s)
involves such transfers, you have certain rights which are described
below.
You may access your account 24 hours a day, 7 days a week using
JDECU’s Cu at Home service, your access number and your password.
From a personal computer with internet connection, by typing www.jdecu.org
and clicking on CU at Home, you may perform the following transactions:
- Transfers. You may transfer funds between your
share (savings) account, share draft (checking) account, special
club accounts and loans as the account agreements may allow. Transfers
from any savings account except the checking are limited to 6
per calendar month in any combination of online, pre-authorized
and telephone transfer. Christmas and Vacation Club accounts have
additional limits of 1 withdrawal per year.
- Balances. You may view your deposit account
and loan balances. There may be checks written against your balance
or other electronic items such as automatic insurance deductions
that have not yet been presented to the credit union for payment.
- Transaction History. You may view the transaction
history for any deposit account or loan.
- Dividends. You may verify current dividend
postings to your accounts. You may also verify previous and current
year dividends earned on your account.
- Loans. You may verify loan types, next payment
due date, loan payoff amounts and current loan balances.
- Password Changes. You may change your password
at any time from within the CU at Home service section. For your
protection we recommend you change your password regularly.
- Check Search. You may search for checks that
have cleared your account. You may also list check clearings by
date or by check number.
- Additional Services. From time to time we
will announce additional services that are available through our
CU at Home service. Your use of these services will constitute
acceptance of the terms and conditions presented at the time they
are announced.
Links to third party sites:
The JDECU Web Site may contain links to third party Web sites (“Linked
Sites”). The Linked Sites are not under the control of JDECU
and JDECU is not responsible for the contents of any Linked Site,
including without limitation any link contained in a Linked Site,
or any changes or updates to a Linked Site. JDECU is not responsible
for web casting or any other form of transmission received from
any Linked Site nor is JDECU responsible if the Linked Site is not
working appropriately. JDECU is providing these links to you only
as a convenience, and the inclusion of any link does not imply endorsement
by JDECU of the site or any association with its operators. You
are responsible for viewing and abiding by the privacy statements
and terms of use posted at the Linked Sites. Any dealings with third
parties (including advertisers) included within the JDECU Web Site
or participation in promotions, including the delivery of and the
payment for goods and services, and any other terms, conditions,
warranties or representations associated with such dealings or promotions,
are solely between you and the advertiser or other third party.
JDECU shall not be responsible or liable for any part of any such
dealings or promotions.
No unlawful or prohibited use:
As a condition of your use of the JDECU Web Site, you will not use
the JDECU Web Site for any purpose that is unlawful or prohibited
by these terms, conditions, and notices. You may not use the JDECU
Web Site in any manner which could damage, disable, overburden,
or impair any JDECU Web Site (or the network(s) connected to any
JDECU Web Site) or interfere with any other party’s use and
enjoyment of any JDECU Web Site. You may not attempt to gain unauthorized
access to any JDECU Web Site or other accounts, computer systems
or networks connected to any JDECU Web Site, through hacking, password
mining or any other means. You may not obtain or attempt to obtain
any materials or information through any means not intentionally
made available through the JDECU Web Site.
Operating Systems and Security
Our CU at Home site is designed to operate using the World Wide
Web technologies and protocols, which are adaptable to a wide range
of systems. The CU at Home section uses SSL encryption and requires
a browser with a current (un-expired) Thawte Root CA Security Certificate.
Our server uses 40 to 128 bit encryption, depending on the browser.
We use cookies to help us administer the CU at Home section. Some
browsers allow you to reject cookies from servers. If you don’t
allow us to set a cookie upon entering the site, you will not be
able to log in. The cookie we set contains information we need for
security, and allows us to “time out” your authority
to view information. We place the cookie with instructions that
it can only be sent to a server in our home banking domain (homecu.net).
A cookie cannot be used to extract data from your PC. We do not
store your Access Code, User ID, or Password in your cookie.
The cookie we set will “timeout” your access authority
to our CU at Home section. Until it times out, you can come back
to our CU at Home section without logging in. After the time out
period, you will need to log in again. Remember, most browsers will
let you use a BACK button to view previously visited documents even
if your viewing authority has expired. For this reason, the only
way to keep others from viewing your account balance is to exit
the browser when you are finished with your session. This is especially
important if you are using a public or share computer.
Liability for Unauthorized Transfers
Tell us at once if you believe your password
has been lost or stolen and immediately change your password from
within the CU at Home section. Calling is the best way to notify
us immediately. You could lose all the money in your account. If
you tell us within two (2) business days after you learn of the
loss or theft of your password, you can lose no more than $50 if
someone used your password without your permission.
If you do not tell us within two (2) business days, and we can
prove that we could have stopped someone from using your password
without your permission if you had told us, you could lose as much
as $500.
Also, if your statement shows a transfer that you did not make,
tell us at once. If you do not tell us within sixty (60) days after
the statement was mailed to you, you may not be reimbursed money
you lost after sixty (60) days if we can prove that we could have
stopped someone from taking the money if you had told us in time.

Your Ability to Stop Payments
Unless otherwise provided in this agreement, you may not stop payment
of Electronic Fund Transfers. Therefore you should not employ electronic
access for purchases or services unless you are satisfied that you
will not need to stop payment.
The initiation by you of certain Electronic Fund Transfers from
your account will, except as otherwise provided in this agreement,
effectively eliminate your ability to stop payment of the transfer.
Each time you make a transfer from one account type to another within
the CU at Home site, you will be asked to confirm the transaction
by clicking on the transfer button. Please review the transaction
carefully before completing the transfer.
Documentation
You will receive a monthly statement from us for your share draft
(checking) account. You will receive a monthly account statement
from us for your share (savings) accounts, unless there are not
transfers to or from your accounts in a particular month. In any
case, you will get a statement at least quarterly.
Business Days
Our business days are Monday through Friday. Holidays are
not included. If the end of the calendar month falls on a Saturday
or Sunday or holiday, we normally “close our books”
on the preceding business day after the close of business. Transfers
made using CU at Home after the books are closed or on a weekend
or holiday will be treated for dividend and interest calculation
purposes as if they occurred on the first day following the weekend,
holiday, or on the first day of the following month. These transactions
will be included with the statement of the next month’s activity.
If having a record of the date on which you make a loan payment
is important to you for income tax reporting purposes, you may want
to make the payment on or before the close of the last business
day of December to make sure it will appear on your Year-End statement.
Our Liability
If we do not complete a transfer to or from your account on time
or in the correct amount according to our agreement/disclosure with
you, we will be liable for your losses or damages. However there
are some exceptions. We will not be liable, for instance:
- If through no fault of ours, you do not have enough money in
your account to make the transfer.
- If the home banking equipment or software was not working properly
and you knew about the breakdown when you started the transaction.
- If circumstances beyond our control (such as fire or flood)
prevent the transfer despite reasonable precautions that we have
taken.
We shall not be responsible for any other losses, damage or injury
whether caused by the equipment, software, and/or the CU at Home
service, nor shall we be responsible for any direct, indirect, special
or consequential damages arising in any way out of the installation,
use or maintenance of your equipment, software and/or service, except
where the law requires a different standard. We do not make any
warranties concerning the equipment, the software or any part thereof,
including without limitations, any warranties of fitness for a particular
purpose or warranties of merchantability.
Errors or Questions
In case of any errors or questions about your electronic transfers,
call us at (931) 759-6157 or write us at PO Box 199, Lynchburg,
TN 37352 no later than sixty (60) days after you receive your statement.
Please include the following information in your inquiry:
- Name and account number as it appears on your statement
- A brief description of the error
- The date of the error in question.
If you phone in your complaint or question, we may require that
you send us the information in writing within ten (10) business
days. We will tell you the results of our investigation within ten
(10) business days and correct any error promptly. If we need more
time, we may take up to forty-five (45) days to investigate the
complaint but will provide access to the funds in question after
the ten (10) business days. If we ask you to put your complaint
or question in writing and we do not receive the information within
ten (10) business days, we may not credit your account during the
investigation.
If we determine there was not an error, we will send you a written
explanation within three (3) business days after we finish our investigation.
You may ask for copies of the documents we used in our investigation.
Termination/ Access Restriction:
JDECU reserves the right, at its sole discretion, to terminate your
access to the CU at Home section and the related services or any
portion thereof at any time, without notice.
JDECU may also terminate or suspend your access to CU at Home services
for inactivity, which is defined as failing to log into a particular
service for an extended period of time, as determined by JDECU.
Upon termination of the CU at Home service, your right to use the
CU at Home service immediately ceases. JDECU shall have no obligation
to maintain any content or to forward any unread or unsent messages
to you or any third party.
